Subject: USCIS Releases New Forms for Immigrant Investor Program

U.S. Citizenship and Immigration Services has released two new forms under the EB-5 Reform and Integrity Act of 2022, which revised INA 203(b)(5).

The new forms are: Form I-956F, Application for Approval of an Investment in a Commercial Enterprise, and Form I-956G, Regional Center Annual Statement.

Form I-956F is a new form that can only be filed by an approved regional center. Form I-956F is similar in some respects to an “exemplar” submission on Form I-924 under the previous program; however, Form I-956F is required by statute for regional centers to apply for approval of each particular investment offering through an associated new commercial enterprise.

Form I-956G takes the place of Form I-924A from the previous program but incorporates the increased statutory reporting requirements.

The next series of forms USCIS will be releasing are Form I-526, Immigrant Petition by Standalone Investor, and Form I-526E, Immigrant Petition by Regional Center Investor. USCIS will notify stakeholders once these forms are available on our website.

Effective June 2, Forms I-956F and I-956G must be submitted in compliance with new program requirements. The filing fee is $17,795 for Form I-956F and $3,035 for Form I-956G.

    @Suzanne – not relevant to your post, but just wanted to share the GREAT NEWS that grandfathering actions have truly started in full swing!! NVC just scheduled our Mumbai visa appointment dates for Jul 25, 2022!! As perspective, our 526 priority date was Sep 8, 2018, 526 approval was Nov, 2020, we submitted our visa applications in Mar2021, and our documents were declared complete mid Jun 2021. It’s been a loooong wait, but so thrilled that our interview appointments are now scheduled! Hopefully the interviews should be smooth! My daughter who is in the US can go back as a junior as an American resident, and my son will apply this Fall as an American resident!! As soon as we get our green cards, I plan to make contributions to you and AIIA as a token of our gratitude for being such champions to us migrants and keeping our hopes alive through your authenticity🙏🙏

      Congratulations for great news.

      I recently submitted my visa application at NVC however there is no option of submitting civil documents. did you submit the civil documents by mail or online at NVC?

      Also is it Regional or Direct petition?

        @Meh : I think the civil documents were uploaded separately by my lawyer. My DS-260 form was also filled by my lawyer based on the information I provided but the final submission was done by me. It was a Regional Center petition. Hope this helps answer your question.

          @RPG – Thank you for the update. My attorney submitted the civil document last week and I got the NVC email today morning confirming that they received everything and my petition is in queue at overseas. I am not sure how long usually it takes to get the letter for medical and visa interview for ds-260 filled in 2022.

          We have total 17 people who already received interview letter. Some of them already got the visa in May and June. All of them have filed ds-260 in 2021.
